Series 1407
District Court (Second District : Weber County) Minutes
Dates: i 1896-
These records are housed in the Utah State Archives' permanent storage room.
Scope and Content
Minute books contain court actions from the criminal, civil, and probate divisions and document the daily proceedings of the court. However, minute book entries are not transcripts of court cases. Business matters include court site and officers present, jury selection, judicial appointments, expense claims, as well as entries noting the day's proceedings on various cases. A typical case will span multiple dates and will include an indictment or indication of the filed complaint, procedural issues, presentation of the case, witnesses' names, the verdict, and precise sentencing or settlement.
Arrangement
Chronological by court date.
With the addition of a second judge in 1911, a department designation is used to distinguish daily entries for each. A third judge (department) was added in 1951. Separate volumes are arranged in numerical order.

Access Restrictions
Utah law, enacted in 1941, sealed all adoption records with the exception that they can be released upon a court order expressly permitting inspection (Laws of Utah, 1941, chapter 17, 14-1-15). This restriction has subsequently been amended (1999) to allow public access one hundred years after the date of final decree or access as provided for in a mutual consent registry (Utah Code 78-30-15, 18). The probate division's jurisdiction over adoptions preceded the enactment of these laws and therefore many adoption records were cited in record books kept by the court. Utah State Archives staff supervises access to this series in order to provide access to probate records, but not to adoption records.
Preferred Citation
Cite the Utah State Archives and Records Service, the creating agency name, the series title, and the series number.
Processing Note
The Utah Judicial Council has determined that minutes are permanent records. Microfilming and destruction of the original records was authorized by the court clerk (RDR dated 15 February 1963 and approved March 1963). Archival processing of the minute books in the custody of the state archives (volumes 1-67 and covering the period from 7 January 1896 to 7 July 1961) was completed in April 1999 by W. Glen Fairclough, Jr. Microfilming of these volumes was completed in 2002.
